Eminent Domain & Just Compensation
Supported residential valuations for property owners in Jacksonville and surrounding northeast Florida facing eminent domain or partial takings.
When a government agency or authorized entity uses eminent domain to acquire private property for a public purpose — a road widening, utility easement, drainage project, or similar taking — property owners are entitled to just compensation. Determining that compensation starts with a credible, independent opinion of value. A condemnation appraisal documents what the whole property is worth and, in a partial taking, what the acquired portion is worth and how the taking affects the remaining property.
SC Real Estate Appraisals prepares residential valuation reports for property owners across Jacksonville and the surrounding northeast Florida communities. We are an independent third party: the appraisal is a supported opinion of value, not advocacy or legal advice, and it does not guarantee a settlement or compensation amount.
In a whole taking, the entire property is acquired, and the appraisal establishes its market value as of the effective date. A partial taking is more nuanced: only part of the property is taken, so the appraiser must analyze the value of the portion acquired and whether the remainder is affected — for example, by changed access, a reduced building site, or a new easement. How those elements relate to value depends on the property and the market, and no factor automatically produces a set adjustment. The methodology is driven by the assignment's scope and intended use.
The appraiser evaluates the property's living area, lot size and shape, access, condition, highest and best use considerations, and any features affected by the taking. Recent comparable sales of similar properties are analyzed, and where the taking alters a specific attribute — frontage, acreage, access — that change is considered in the context of the local market. The report is a documented, USPAP-compliant opinion of value that owners and their attorneys can use in negotiations or proceedings.
Condemnation is a legal process with specific deadlines and procedures. We recommend engaging an attorney experienced in eminent domain before or alongside the appraisal. Your counsel determines the effective date, the legal theory, and whether the taking should be challenged; we provide the valuation that supports those decisions. Documents such as the condemning authority's offer, plats, surveys, and the deed help us prepare an accurate report.
Eminent domain activity often follows infrastructure and development, and comparable sales must reflect the local market where the property sits. Our coverage includes Duval, Clay, Nassau, Baker, and St. Johns counties, where growth and road projects affect a range of residential properties — from small in-town lots to larger rural tracts with acreage, wells, or septic systems.
